Court dismisses lawsuit filed by resigning residents who opposed increase in medical school enrollment, seeking to revoke enlistment disposition.

The Seoul Administrative Court has dismissed the appeal of six medical officers who had resigned in protest against the government's "medical university recruit" policy, which resulted in a delay in their posting. The court ruled on July 10 that the administrative action taken by the court was not appropriate to hear the case. The medical officers had resigned in response to the government's policy, which led to an increase in the number of individuals in posting status.

The army's Personnel Act stipulates that upon retirement from training institutions, medical officers must be posted as commissioned officers or public health officers. In response, the Ministry of National Defense revised its regulations in February last year to classify medical officers who resign as "current non-recruits" for posting.

The court reasoned that the case is merely an internal administrative matter between the Ministry of National Defense and the Ministry of Education, and that the classification notice does not affect the medical officers' rights or obligations.
