Retired military officer with ‘Datuk’ title charged over alleged caddie molestation in Ayer Keroh

A 68-year-old retired military officer with the title "Datuk," named Yahya Hashim, appeared in the Ayer Keroh Magistrates' Court on September 4, 2024, charged with using criminal force against a 20-year-old female caddie. This alleged incident took place on August 25, 2024, at the Tiara Melaka Golf & Country Club in Ayer Keroh, Melaka. The alleged act occurred between 8:30 am and 12:30 pm, during which Yahya is accused of using criminal force with the intent to outrage the modesty of the 20-year-old female caddie.

Yahya pleaded not guilty to the charge, which falls under Section 354 of the Penal Code. This section provides for up to 10 years' imprisonment, or a fine, or whipping, or any two of these punishments upon conviction. Deputy Public Prosecutor Syauqi Mardia Baharudin requested a RM5,000 bail amount for Yahya, with an additional condition that he not disturb the victim, as she was at work.

Yahya's lawyer, Melvin Tay, requested a lower bail amount, citing his client's retirement, lack of fixed income, and living situation with his wife. Moreover, it was mentioned that Yahya has a prostate-related health condition requiring treatment. The court granted Yahya bail of RM2,500 with one surety and agreed to the prosecution's additional condition that he not disturb the victim until the case is concluded. The case was scheduled for a mention on September 28, 2024.
