Former Cowboys running back Emmitt Smith is sued by investor over wind farm project

Former NFL star Emmitt Smith and his business partner, David Mosley, face a lawsuit from Kituwah LLC, a Native American investment company. The lawsuit alleges that Smith and Mosley misappropriated a $2.5 million loan intended to fund a wind farm project in Texas. Kituwah claims that 4 13 Solutions, the company linked to Smith and Mosley, used the funds to repay an investor from previous dealings with Smith’s company instead of investing in the wind farm project.

The lawsuit further alleges that Smith and Mosley misrepresented their efforts to secure a U.S. Department of Energy loan, which would have triggered repayment to Kituwah. Kituwah is seeking damages and is asking a jury to determine the amount. The Dallas Cowboys running back and his company have not yet responded to the allegations, which the lawsuit compares to a "ponzi scheme."
