Norway seizes Russian ship to enforce $4.2 billion claim by Ukrainian energy firm

Norway seized a Russian vessel, the Professor Molchanov, in the Arctic Ocean to collect a $4.22 billion compensation demand from Ukrainian energy company Naftogaz. The action came after a 24-hour standoff between the Norwegian Coast Guard and the Russian ship off Svalbard, an Arctic archipelago.

Covington, the US law firm representing Naftogaz, had been monitoring the ship's movements for months. When the vessel was en route to Barentsburg, a Russian mining settlement, Naftogaz sought a Norwegian court order to arrest the ship and order its compulsory sale. The court granted the request, commanding the Svalbard governor to seize and hold the vessel.

Naftogaz has been seeking compensation against Russia since 2016 for the theft of its property in Crimea when Russia annexed the region in 2014. A tribunal in The Hague ruled in 2023 that Russia must pay $4.22 billion plus interest and legal costs, but Moscow has not complied. Naftogaz CEO Sergii Fedorenko emphasized that Russia cannot avoid responsibility by simply rejecting the international arbitral award.

Covington tracked the Professor Molchanov for months, anticipating its arrival in Svalbard and applying for the arrest order. The Norwegian court approved the seizure and required the governor to enforce the order and oversee the vessel, preventing any movement.

Naftogaz plans to enforce the seizure in multiple jurisdictions, including the United States, France, the United Kingdom, and Finland, where Russian assets have already been frozen. Russia has rejected the Norwegian action, calling it "piracy" and alleging that Norway did not provide proper notice. The Russian government plans to contest the ruling and will continue targeting Russian assets worldwide until the awarded compensation is paid.
