Lindsay Clancy mistrial more likely after jurors tell judge they're deadlocked for second time

The Lindsay Clancy murder trial jury has entered its second day of deliberation, now in its 30th hour, with no verdict reached. The ongoing deliberations come after weeks of testimony exploring whether Clancy suffered from postpartum psychosis during the 2023 killings of her children and whether she should be held criminally responsible.

On Wednesday, the jury signaled they were at an impasse for a second day in a row. Judge William Sullivan then instructed the jurors to continue their deliberations in accordance with the Tuey-Rodriguez instruction, which asserts that it is their duty to reach a verdict if they can do so conscientiously and that there is no reason to believe a more competent or impartial group would decide the case differently.

Criminal defense attorney Peter Elikann suggested that if the deadlock persists, the judge may declare a mistrial. If a mistrial is declared, the defense may request bail or release, allowing the defendant to be freed pending the prosecution's decision on whether to retry the case. The prosecution could choose to retry Clancy immediately or at a later date.

Alternatively, the attorneys noted, plea negotiations could take place, potentially leading to a reduced charge. Legal analyst Brian Buckmire stated that while a mistrial is not particularly likely, it is not out of the question. Elikann noted that this outcome, while unusual, is not entirely unforeseeable, especially given the jury's apparent inability to reach a conviction on first-degree murder charges.
