Pertikaian babit GrabCar kes pertama didengar Tribunal Pekerja Gig

The inaugural hearing of the Gig Worker Tribunal (TPG) took place on September 1st, marking the beginning of a dispute resolution mechanism under the Gig Workers Act 2025 (Act 872). The Ministry of Human Resources (MHR) said the first case heard by TPG involved a dispute between an e-rickshaw driver and GrabCar Sdn Bhd, the platform provider.

The hearing, presided over by TPG Deputy President Suzarika Sahak at the Tenaga Kerja Office in Kuching, Sarawak, delved into issues surrounding the usage and operation of the GrabCar platform, including Saver Trips, cashback incentives, and Advance Booking. In this case, the plaintiff represented herself, while GrabCar Sdn Bhd was represented by one of its employees.

"The matter has now been scheduled for a later date for further testimony and examination of witnesses," said MHR. According to MHR, TPG also received several other dispute filings, including issues related to account activation or suspension, loss of earnings, reinstatement of accounts, and platform service claims. Besides e-rickshaw and ride-hailing platforms, the tribunal also dealt with complaints from non-platform-based gig workers, such as payment claims for completed services.

Act 872 covers both platform-based and non-platform-based gig workers, including sectors like e-rickshaw, taxi, security, entertainment, and other service sectors, with provisions for additional sectors to be added in the future. A dedicated online portal was launched to allow workers to lodge complaints, with decisions to be provided within 21 days. Disputes can be resolved through mediation and, if unsuccessful, referred to TPG.
