Pertikaian babit GrabCar kes pertama didengar Tribunal Pekerja Gig

The first hearing of the Gig Worker Tribunal (TPG) took place on September 1st at the Labor Department office in Kuching, Sarawak, presided over by TPG Deputy President Suzarika Sahak. This marks the beginning of the dispute resolution mechanism under the 2025 Gig Worker Act (Act 872). The Malaysian Human Resources Ministry (Kesuma) announced that the first case heard by the TPG involved a dispute between an e-rickshaw driver and GrabCar Sdn Bhd, the platform provider.

The proceeding, presided by TPG Deputy President Suzarika Sahak at the Labor Department office in Kuching, Sarawak, touched upon issues related to the use and operation of the GrabCar platform, including the Saver Trips, cashback incentives, and Advance Booking features. In this case, the plaintiff represented herself, while GrabCar Sdn Bhd was represented by one of its employees.

The Ministry noted that TPG would also receive various other disputes, including issues of account activation or suspension, loss of earnings, reactivation of accounts, and platform services. Beyond ride-hailing platforms, the tribunal also dealt with complaints from non-platform workers, such as claims for payment for completed services.

The 2025 Gig Worker Act encompasses both platform-based and non-platform-based workers, including sectors such as e-rickshaws, taxi services, security, entertainment, and other service sectors, with the potential for additional sectors to be included in the future. A dedicated online system was launched to allow workers to lodge complaints, with decisions expected within 21 days. Disputes could be resolved through mediation, and if unsuccessful, referred to the TPG.
