Two Malaysian school teachers have been urged to reconsider a RM16,000 fine imposed on one of them for physically assaulting three vulnerable female students. SN Nair and V Kokila Vaani, legal professionals, emphasized that while the teacher's guilty plea mitigates the sentence, it should not diminish the severity of the crime committed against children entrusted to their care.

The fine, Nair argued, is disproportionate and insufficient. The victims were three 14, 15 and 16-year-old female students in a position of vulnerability, under the watchful eye of a teacher with authority.

Nair and Vaani called for the court to reassess the sentence and potentially appeal the decision. The National Board of Commissioners for Law, represented by Vaani, stressed that while the sentence aligns with statutory provisions allowing up to 10 years' imprisonment, a fine, or a combination of both, should be proportionate to the crime and serve a deterrent purpose. The teachers in question were found guilty of using physical force against the students to assert dominance.

Asyraf Ahmad, the teacher convicted in this case, admitted to assaulting three female students with the intent to demoralize them. The Malaysian Board of Commissioners for Law noted that while the sentence may seem lenient, it lacks preventive factors. This case differs from another involving an out-of-state school disciplinarian who received a two-year prison term and a RM10,000 fine. The Malaysian courts have historically shown a serious approach to such offenses, often imposing prison terms over fines.
