Supreme Court dismisses injunction bid seeking to halt Skytrain trial

The Supreme Court has dismissed an injunction bid from Solomon Asamoah, former CEO of the Ghana Infrastructure Investment Fund (GIIF), aimed at halting the Skytrain trial. Asamoah, the first accused in the case, had requested certiorari to quash the High Court's decision dismissing his submission of no case after the prosecution concluded its argument.

He also sought an interlocutory injunction to restrain the High Court from proceeding with the trial until his certiorari application was resolved. However, on Monday, August 31, 2026, the Supreme Court, sitting as a single-Judge court, denied his injunction request. Justice Senyo Dzamefe ruled that Asamoah's affidavit evidence did not establish a serious case to be tried and that the issues were better handled in an appeal.

The trial court's decision to rule on the submission of no case was found to be within jurisdiction. Asamoah failed to provide proof of the damage that would occur if the injunction was not granted. Consequently, the High Court can now advance the Skytrain trial without awaiting the Supreme Court's decision on the certiorari application.

The High Court has set September 23 as the final extended deadline for the accused persons to submit their defense, if they wish to do so. Meanwhile, the second accused, Professor Christopher Ameyaw Ekumfi, has submitted a new application for a stay of proceedings, which is slated for hearing by the Court of Appeal on September 1.

Asamoah and Ekumfi are facing charges of misappropriating $2 million towards the Skytrain project without the approval of the GIIF Board.
