India Rejects Hague Arbitration Award, Insists Indus Waters Treaty Remains Suspended

On August 31, 2026, the Court of Arbitration in The Hague handed down two significant decisions in the long-standing Indus Waters dispute between India and Pakistan. The tribunal's Award on the status of the Indus Waters Treaty addressed India's decision to suspend the 1960 agreement following the Pahalgam terror attack, as well as Pakistan's concerns over the Ratle Hydro-Electric Plant.

The Permanent Court of Arbitration unanimously ruled that India's April 2025 suspension of the treaty does not legally terminate the agreement. The tribunal rejected India's claims of sovereignty and material breach, finding these reasons insufficient under the treaty and customary international law. Despite this, India has firmly rejected the tribunal's legitimacy, refusing to recognize any of its decisions or awards.

The Indus Waters Treaty, brokered by the World Bank in 1960, remains a cornerstone of regional stability, allocating water resources between India and Pakistan. The current dispute centers on India's Kishenganga and Ratle hydroelectric projects, with Pakistan challenging the design of these projects. As the situation remains unresolved, the future of water-sharing under the treaty hangs in the balance, with both countries at an impasse.
