‘Judges don’t mingle with appointing authorities’ – Amoako Asante defends judicial independence

Supreme Court nominee Justice Edward Amoako Asante has defended the principle of judicial independence, asserting that judges must render decisions based solely on the evidence and relevant law, irrespective of their appointing authority. Speaking before Parliament’s Appointments Committee on Thursday, August 27, Justice Asante emphasized that an oath of office, which he takes upon appointment, serves as a crucial safeguard for impartiality and fairness in adjudication.

“When you’re appointed as a judge, you swear an oath that you adhere to; that's a very important thing you do to ensure fairness and equity for all persons who come before you,” he stated. Justice Asante made it clear that a judge’s decision-making process should not be swayed by personal connections or the individual who appointed them.

“Judges decide on cases by the facts before them and then apply the law to those facts. They do not mingle with the appointing authority just because they appointed them,” he reiterated. He highlighted the significance of an independent mindset in preserving the judiciary’s integrity and deterring undue influence. “Independence of mind is very important, and that is why I have achieved the position I am in today.

I possess the independence of mind to withstand any influences that may come my way and perform my duties effectively,” Justice Asante concluded.
