Judge temporarily blocks Trump administration's attempt to restrict mail-in voting

On Thursday, a federal judge issued an order temporarily blocking the implementation of President Donald Trump's executive order restricting mail voting, a decision that could potentially be revisited by the Supreme Court. U.S. District Court Judge Indira Talwani granted a 14-day reprieve on the administration's directive, just a week before the first mail ballots were expected to be dispatched ahead of the upcoming midterm elections.

In her ruling, Talwani noted that the plaintiffs, which include various states and voting rights organizations, lacked both the necessary time and financial resources to promptly design new mail ballots, secure the approval of the new designs, order the production of mail ballots, update their election management systems, train election officials on the USPS portal, and upload citizen data to the system.

These logistical challenges were cited as the primary reasons why the plaintiffs were unable to comply with Trump's executive order before the midterms. The ruling took place ahead of a scheduled hearing on September 3rd, following the plaintiffs' refiling of their lawsuits in response to the recent Supreme Court decision. The Supreme Court, with its conservative majority, did not directly rule on the constitutionality of Trump's executive order, but they did state that the legal challenges had been filed prematurely.

As a result, the administration has now issued a formal rule to determine how the U.S. Postal Service will deliver mail ballots, effectively reigniting the legal battle. This ongoing legal dispute has significant implications for the midterms, as nearly one-third of Americans cast their votes by mail, and election officials are concerned there is insufficient time to modify their systems in order to adhere to the new Postal Service guidelines.
