Dr Victoria Mutiso murder case: Court orders Rose Mbithe, her 2 children to undergo mental assessment

The Milimani High Court in Kenya has mandated Rose Mbithe Mulwa, also known as Rose Mbithe Ndetei, and her two children, advocates Chris Mulwa and Angela Mulwa, to undergo a psychiatric examination prior to entering a plea on charges of murder. Justice Kanyi Kimondo made this decision on Thursday, August 27, 2026. The three individuals involved in the alleged murder of Dr Victoria Nthunya Mutiso are required to be assessed at Mbagathi Mental Hospital or any other suitable facility within Nairobi.

Judge Kanyi emphasized that the suspects are prohibited from commenting or pleading to the murder charge until they have undergone the mental evaluation.

Justice Kanyi further ordered that Rose Mbithe and her daughter, Angela Mulwa, be held in Lang’ata Women’s Prison, while Chris Mulwa will be detained at Nairobi Remand Prison until the mental assessment is completed. The court has postponed the plea hearing to September 23, 2026, which will now be heard by Justice Alexander Muteti. The court has also stated that any other matters the defense wishes to address will be handled by Judge Muteti.

The Director of Public Prosecutions (DPP) plans to charge the three suspects with murder under sections 203 and 204 of the Penal Code. According to the DPP, the alleged murder took place on July 29, 2026, around 9:30 am near Mawensi Road in Kilimani Sub-County.
