Ministry to explain withdrawal of appeal against nicotine vape exemption

Health Minister Dzulkefly Ahmad announced that the government will explain its decision to withdraw its appeal against a High Court ruling that deemed the exemption of liquid nicotine from the poisons list to be unlawful. The withdrawal of the appeal, according to Ahmad, is due to several legal and policy implications that need to be addressed.

He emphasized the need for the Poisons Act 1952 and the Control of Smoking Products for Public Health Act 2024 to remain aligned. The media briefing, scheduled to take place before the Asean health ministers meeting early next month, aims to clarify the government's position and the possible outcomes if it had decided to challenge the ruling.

The decision not to appeal does not signify an end to the government's efforts to regulate vaping; rather, the Act 852 will continue to be enforced to protect minors and safeguard public health. Specific details regarding the government's approach to regulating vaping, particularly concerning open-system vape products, will be presented during the briefing.

Meanwhile, the health minister also addressed the worsening haze situation, which has led to a significant increase in unhealthy air quality readings and respiratory-related cases. The ministry is providing guidance to vulnerable groups and urging everyone to reduce outdoor exposure and stay indoors.
