Court rejects woman’s bid to obtain toddler’s birth certificate

In a recent ruling, the Kuala Lumpur High Court denied a woman's request to obtain her husband's extramarital child's birth certificate. The woman, who alleged the child was born from her husband's affair, sought the birth certificate to bolster her divorce petition. However, the court dismissed her application as speculative and likened it to a fishing expedition.

The child, identified as J, was born to C, the mother who denied having an affair with the woman's husband. The court received confirmation from the national registration department that while C is J's biological mother, the father's details were marked as "information unknown." Judicial Commissioner Nixon Kennedy Kumbong rejected the woman's application, stating that her request was based on suspicion rather than proven fact and that the legal system is designed to prevent such exploratory searches.

The court emphasized the sensitivity of the child's personal information, including identity, maternal details, birthday, and place of birth. Judicial Commissioner Kumbong highlighted that minors' personal data is treated with heightened caution by the courts due to public policy considerations. Moreover, the applicant, who was neither a parent nor a guardian of the child, had no legal relationship with J and no statutory entitlement to access the birth record.
