Taiwan charges nine people, including Nvidia employee, over illegal export of AI servers to China

Super Micro Computer's shares dropped 7% on Monday after Taiwan indicted nine employees, including two from its local unit, for illegally exporting 74 AI servers to China using falsified documents. Dell Technologies' stock slipped 2%, while NVIDIA and HPE remained steady as markets interpreted the case as individual employee misconduct, not a corporate export-control failure.

Super Micro Computer is grappling with two overlapping compliance risks: the indictment and an independent board review of export-control transactions. The indictment specifically charges nine individuals with breach of trust and document forgery, stating they were aware of Super Micro Computer's rigorous internal controls. The indictment centers on 130 B300 servers ordered from Super Micro Computer, with 74 actually shipped to Chinese customers through various countries.

The remaining 56 units were destined for a Japanese company before customs officials stopped the export. The U.S. has required licenses for such exports to China since 2022, making the indictment a significant compliance issue for Super Micro Computer. Despite the significant revenue and order size of Super Micro Computer, the stock's decline is isolated from the broader tech market, with iShares U.S. Technology ETF down only 2%.

Dell Technologies, a peer in the AI-server market, also saw a 2% drop. Investors are reading the indictment as a case of employee-level misconduct rather than a corporate export-control failure, keeping the impact largely contained to Super Micro Computer.
