Aide says justice nominee recommendation without consultation infringes on presidential rights

Seoul, August 24 - A senior presidential aide stated on Monday that the Chief Justice's decision to recommend Supreme Court justice nominees without prior consultation may have violated the president's right to appoint public officials. Hong Ik-pyo, the presidential secretary for political affairs, made this statement during a parliamentary session a week after the Chief Justice, Cho Hee-dae, made the recommendations in writing, deviating from the usual practice of presenting the nominees in person after consultation with the president.

Cho, appointed by former conservative President Yoon Suk Yeol, submitted the recommendations without following the customary process of discussing them with the president beforehand. The presidential secretary expressed agreement with the notion that the president's authority to appoint public officials had been compromised to some extent in this instance.

When questioned about the legality of the recommendations, Hong replied that legal matters should be evaluated after examining the procedures, but noted that this approach was far removed from the established customary practice. Cho contended that Cheong Wa Dae opposed the recommendations because it desired to appoint justices aligned with President Lee Jae Myung, as the president might face trials post-terms.

The remarks from the presidential secretary came in the wake of mounting criticism from ruling party lawmakers who accused the Chief Justice of circumventing the president, with some even calling for his resignation. The main opposition party has accused the ruling faction of attempting to undermine the Chief Justice's authority and legal prerogative to recommend justice nominees, while PPP leader Rep. Jang Dong-hyeok emphasized that such authority was a crucial safeguard for judicial independence.
