The health think tank Galen has urged the Malaysian government to ban the sale of nicotine-containing electronic cigarette liquids and e-liquids for public health reasons. PETALING JAYA: The health think tank has called on the government to clarify the legal status of nicotine liquids and e-liquids, following its recent withdrawal of support for the court’s decision that the exemption of these substances from the list of carcinogens was unlawful and irrational due to a lack of proper consultation with the Drug Institute.

Galen, part of the Foundation for Health and Social Development, stated that leaving the legal status of nicotine liquids and e-liquids pending leaves their regulation in limbo. Executive Director Azrul Khalib explained that this creates uncertainty about how the newly passed Poisons and Dangerous Drugs Act will work together, as the new act does not address the legal status of nicotine liquids and e-liquids.

So, is the sale of vape liquids and e-liquids containing nicotine already banned? The government previously argued that the exemption for nicotine liquids and e-liquids was necessary to allow these products to be taxed and regulated legally. The relaxation of the exemption effectively nullifies the previous exemption, according to Galen.

Azrul urged relevant ministries to provide clear guidance to all stakeholders in this matter, as the country cannot endure another period of legal uncertainty concerning nicotine products. Last May, the Federal Court in Kuala Lumpur struck down the minister’s order removing nicotine liquids and e-liquids from the list of carcinogens, finding the decision unlawful and irrational because it was made without proper consultation with the Drug Institute.

The court found that the exemption was driven by economic considerations related to the government’s plan to impose a tax on nicotine-containing vape liquids.
