Lohngerechtigkeit: Urteil: Daimler Truck muss Managerin 210.000 Euro nachzahlen

The Baden-Württemberg State Labour Court has ruled in favor of a female manager in a gender discrimination case involving Daimler Truck. The female executive received around 210,000 euros in compensation for the years 2018 to 2022, which was partially successful in her legal battle. The woman compared herself to the top earner among her male department heads as a benchmark for her earnings, which she believed were insufficient.

The state labour court stated that the defendant failed to disprove the existing presumption of gender-based disadvantage for the plaintiff. However, she was entitled to the difference between her earnings and the median salary of the male comparison group at the same hierarchical level. The median salary is the income at which an equal number of full-time employees earn more and fewer, making it a more reliable measure than the simple average, as it is not skewed by high earners.

Daimler Truck's spokesperson explained that the company had presented its views on equality, comparability, and individual performance in the proceedings. The court confirmed that the plaintiff was not entitled to the compensation of the individual she named as a comparison. "Daimler Truck does not have a structural gender disadvantage for either union or non-union employees."

The proceedings have now concluded with the issuance of the judgment, and no further appeal to the Federal Labour Court is permitted (case number 2 Sa 14/24).
