MHA Asks States To Fast-Track Extradition Pleas, Bring Jails Up To Global Standards

The Ministry of Home Affairs (MHA) has urged Indian states and Union Territories to expedite extradition requests for fugitives abroad, emphasizing that delays could hinder India's efforts to apprehend them. The MHA has also instructed authorities to establish facilities in central jails that meet international standards. This comes as India intensifies its attempts to secure the return of fugitives from overseas.

Between 2021 and the present, India has successfully extradited 274 individuals from 36 countries via extradition and deportation methods. Delays in processing extradition requests can allow fugitives to evade capture, as foreign authorities must comply with their domestic laws and treaty obligations. If a formal extradition request isn't submitted within the permitted timeframe, a fugitive may be released, leading to the expiration of provisional arrest periods or the individual leaving the foreign country's jurisdiction.

Tracing and apprehending the fugitive again could subsequently become extremely challenging. The warning underscores a critical vulnerability in the extradition process: locating a fugitive overseas is merely the initial step. Without the expeditious submission of legally sound paperwork, the opportunity to secure the person's return could be forfeited.

The Ministry has advised states, Union Territories, and law enforcement agencies to prepare extradition documents in advance, particularly in cases involving Interpol Red Notices. This proactive approach would enable the immediate submission of provisional arrest or formal extradition requests upon locating or arresting a fugitive abroad.

Advance preparation is crucial due to the involvement of multiple agencies and jurisdictions in extradition proceedings, which can be susceptible to administrative delays when foreign authorities operate under stringent legal deadlines. Additionally, the MHA is focusing on upgrading prison facilities to align with international standards and coordinating extradition cells with adequate resources.

These measures aim to fortify India's extradition process, ensuring timely paperwork, effective coordination among agencies, and compliance with international standards.
