India courts will decide extradition of Sheikh Hasina, talks on to change course

India's judiciary will ultimately decide whether to extradite Bangladesh's ousted Prime Minister Sheikh Hasina, according to top government officials. While intense discussions are underway with Dhaka to adjust their position, the final decision will be made by Indian courts, not by political or diplomatic means. Hasina herself has expressed her intention to return to Bangladesh in December, referring to the 1971 Bangladesh Liberation War.

Currently, she faces a death sentence in Bangladesh and her Awami League party is banned. The extradition request is part of ongoing diplomatic talks between India and Bangladesh. India has had Sheikh Hasina in unofficial asylum in New Delhi since the August 2024 mass uprising in Dhaka. She has been in contact with her party cadre in Bangladesh and has occasionally held in-person consultations.

If extradition proceedings begin in an Indian court, the verdict from the International Crimes Tribunal (ICT) in November 2025, which convicted her of "crimes against humanity," may be challenged.
