Bentley owner wins RM900,000 payout after Kelana Jaya crash, Appeals Court rejects staged-accident claim

PUTRAJAYA, Aug 14 — The Court of Appeal has upheld a High Court ruling that an insurance company must pay RM900,000 in compensation to a businessman for damages to his Bentley Continental. The decision came after both MSIG Insurance (Malaysia) Bhd and Inderpal Singh's appeals were dismissed, with each party paying RM50,000 in costs.

MSIG Insurance had contested the High Court's decision allowing Inderpal's claim for indemnification under the insurance policy, while Inderpal appealed against the dismissal of his claims for negligence and consequential losses. Justice Choo confirmed that the court found no errors in the High Court's evaluation of the evidence.

Although MSIG Insurance presented an alternative explanation for the accident, the court did not overturn the trial court's findings. The court also ruled out the possibility of Inderpal staging the accident, as there was insufficient evidence to support this claim. Inderpal, the registered owner of the Bentley, had the comprehensive insurance policy covering RM900,000 in damages.

On January 22, 2020, the vehicle collided with a guardrail during an attempt to avoid hitting a dog on the road in Kelana Jaya. Despite the collision, Inderpal filed a claim, alleging breach of contract and negligence by the insurance company. The High Court ruled in favor of Inderpal, but the insurance company appealed, which was dismissed by the Court of Appeal.
