SC gets court nod for committal proceedings against Tan Bee Geok

The Securities Commission (SC) has secured permission from the Kuala Lumpur High Court to begin committal proceedings against Tan Bee Geok for violating the terms of a consent judgment issued on September 17, 2020. This consent judgment stemmed from an SC investigation into Tan's breach of Section 188(3)(a) of the Capital Markets and Services Act 2007. The act in question involved Tan passing on inside information about APL Industries Bhd to her sister, Tan Bee Hong.

In the consent judgment, Tan agreed to a range of conditions, including a ban on serving as a director or participating in management of any public listed company or its subsidiaries for five years from the date of judgment. Despite this prohibition, Tan carried on with her role as a director in subsidiary companies of a PLC while continuing to manage them. This action, according to the SC, amounted to a breach of the terms of the consent judgment.

Consequently, the commission initiated an ex-parte application on September 17, 2025, requesting the High Court's consent to commence committal proceedings against Tan. The High Court subsequently decided to hear the application by an opposed ex-parte process. On Wednesday, High Court judge Leong Wai Hong granted the SC's application, thereby allowing the commencement of committal proceedings against Tan.
