48-hour notice before clamping wrongly parked car

A Mumbai resident who purchased a flat from Punjab National Bank (PNB) through an auction was wrongly penalized by his housing society for parking his six vehicles. Despite providing all necessary documents and settling dues, the society refused to recognize his membership and imposed hefty charges. When Sottany bought the property, he was allocated one parking space, but requested additional spaces for his six vehicles, which were denied.

The society, claiming only 50 parking spots for visitors, threatened Sottany with penalties for parking violations. The society passed a resolution to penalize members who wrongly park their vehicles using wheel clamps or clamps on the tyres. Sottany contested the decision in court, but the interim court ruled in favor of the society, stating that the homeowner lacked standing to challenge the resolution and had no independent right to override the parking regulation.
