Terrace water leakage: homeowner wins Rs 3.96L

Mr Shah, a senior citizen residing in a Mumbai housing society, faced a 14-year legal battle to claim compensation from his housing society for water leakage caused due to faulty roof work. The society, in an attempt to cover the repair costs, awarded a contract to contractor Dhami, with consultant Mhatre. The repair work began in December 2006 and was completed by May 2007, including a 10-year guarantee for the work.

The society claimed that there was no leakage, but Shah, whose two top-floor apartments were affected, disagreed. He alleged that contractors damaged the RCC slab, leading to water leakage and damage to his flats' interiors. The housing society suggested Shah to hire his own contractor, which he rejected. Shah then took the matter to the Maharashtra Co-operative Court, and in April 2012, the court held that the society was responsible for repairing the terrace leakage due to the 10-year guarantee.

In July 2026, Mr Shah won the case in Maharashtra Co-Operative Appellate Court after presenting documentary evidence confirming the persistent leakage and the society's failure to rectify the issue. The court awarded him Rs. 2 lakh, with 7% annual interest, for the financial loss and mental distress caused by the prolonged inaction.
