Mahkamah kembalikan konsesi Menara KL sebagai defendan saman RM1 bilion

A petition seeking the annulment and invalidity of the concession granting LSH Service Master Sdn Bhd control over Menara Kuala Lumpur has been dismissed, and the company and its parent companies are once again named as defendants in a RM1 billion lawsuit. The High Court unanimously ruled that LSH Service Master and its shareholders, LSH Best Builders Sdn Bhd and Service Master (M) Sdn Bhd, should not be removed from the lawsuit by the Supreme Court.

The panel also allowed Hydroshoppe and Menara KL to amend their claims, rejecting the argument that the amendment was a tactical move. The court found the amendment was made at an early stage of proceedings with the intention of doing good, without any evidence of a bad intention. The three companies were ordered to pay RM30,000 in costs to Hydroshoppe and Menara KL, while the government and Communications Minister Fahmi Fadzil were ordered to pay RM15,000.

Hydroshoppe and Menara KL filed the lawsuit last year to have the LSH Service Master concession to manage Menara KL declared null and void and to seek around RM1 billion in compensation and return of the concession. The High Court had previously allowed the lawsuit to proceed against the government and Fahmi, but dismissed the claims against LSH Service Master, LSH Best Builders Sdn Bhd and Service Master (M) Sdn Bhd.

LSH Service Master and LSH Best Builders are subsidiaries of LSH Capital. The legal proceedings between LSH Service Master and LSH Capital are scheduled to commence from June 28 to July 2, 2027.
