Lelaki sebabkan kematian penunggang dipenjara 6 tahun, denda RM20,000

A Singaporean cleaner was sentenced to six years in prison and a RM20,000 fine by Johor Bahru High Court for dangerous driving that caused the death of a motorcyclist, after pleading guilty to the crime. The incident occurred on August 6th around 4:20 am on Leong Bee Road in Gelang Patah. The High Court judge, Nur Fatin Mohamad Farid, imposed the sentence after T Yuken, 25, admitted to the charges in Tamil.

He was also ordered to serve one year in jail if he fails to pay the fine and an additional RM4,000 to the victim's widow, Noor Adlin Roslan. Upon conviction, he will be barred from holding or obtaining a driving license for five years, and if he holds a provisional license, it will be revoked by the court. The prosecution charged him under Section 41(1) of the Road Transport Act 1987, which can result in a maximum of 10 years in prison and a fine of up to RM50,000.

The prosecution was handled by Deputy Public Prosecutor Muhaizam Rostam Affendi, while the defendant was not represented by a lawyer. The defendant sought leniency due to his remorse and admission of guilt. However, Muhaizam requested the court to consider several mitigating factors before imposing the sentence. He stated that the court should take into account the public interest, as the defendant's mistake was serious due to the potential impact on the safety of other road users.

The victim, Muhamad Isa Damiri, 41, died at the age of 41, leaving behind a wife and four children. The family has lost a husband, father, and a role model, making the incident extremely impactful on their lives. The court has set the hearing for November 10th to reconsider the payment status of the compensation and, if it is not paid, to issue an appropriate order.
