If police stop you in Malaysia, here's what you should know

Malaysia's police have the authority to stop individuals in various situations, such as roadblocks, mall operations, street inquiries, or door-to-door visits. It is crucial to know your rights in these scenarios. If questioned, you have the right to consult a lawyer and inform a family member or trusted friend of your arrest details. Although police should generally allow reasonable time for you to contact them, there are limited situations where they might delay this.

In terms of phone inspections, Malaysian law permits officers to examine your mobile phone under certain conditions, such as reasonable suspicion of an offence, investigation, or arrest. Should an officer request access to your phone, calmly inquire about the reason for the inspection and whether you are under investigation or suspected of committing an offence.

When stopped by a police officer, remain calm and note their name, identification number, and vehicle registration if applicable. If they are not in uniform, kindly request their police authority card. It is important to remember that being questioned does not automatically imply arrest. You can ask, "Am I under arrest?" If the answer is no, you are free to leave.

However, if you are arrested, you must provide your personal details such as name, NRIC number, and address. You may also be required to undergo searches, but more invasive searches require higher levels of authorization. Police can detain you for up to 24 hours before bringing you before a magistrate for a remand order, depending on the investigation's needs.

Lastly, always read any documents provided carefully before signing, ensuring they accurately reflect your statements and seek corrections if necessary.
