ICC will unseal arrest warrants for 4 Taliban leaders wanted on gender persecution charges

The International Criminal Court announced on Monday that it will reveal the arrest warrants issued against four senior Taliban figures for alleged gender persecution against women, girls, and those identifying as LGBTQI+ in Afghanistan since the Taliban took control in 2021. The court revealed the warrants in July and September of last year, although they had remained sealed until now.

The four individuals targeted include the Taliban's supreme leader, Hibatullah Akhundzada, the head of Afghanistan's Supreme Court, Abdul Hakim Haqqani, Education Minister Habibullah Agha, and Minister of Higher Education Neda Mohammad Nadim.

The court charged the suspects with crimes against humanity for gender persecution against women, girls, and members of the LGBTQI+ community. Since the Taliban took control of Afghanistan, women have been barred from work, public spaces, and education beyond the sixth grade. In addition, the Taliban have banned windows facing women in buildings, and Education Minister Agha has banned girls from attending school past the sixth grade.

The court explained that the Taliban, acting on behalf of the group, implemented policies that resulted in severe violations of fundamental rights and freedoms, including murder, imprisonment, torture, rape, and enforced disappearances. The suspects specifically targeted women and girls, preventing them from enjoying basic rights such as education, privacy, and freedom of movement, expression, thought, conscience, and religion.

Furthermore, the court noted that the Taliban targeted others for expressing sexualities and/or gender identities that clashed with the Taliban's policies. Rights groups welcomed the ICC's decision to unseal the warrants against the four Taliban leaders.
