‘Arrests but no accountability’: Concerns raised over lack of prosecution of government officials

In Limpopo, numerous senior officials, including mayors, municipal managers, and chief financial officers, have been apprehended on charges of fraud, corruption, and money laundering. However, most of them have yet to be convicted, a situation that has sparked outrage among the province’s residents, particularly opposition parties.

The Democratic Alliance (DA) recently expressed disappointment over the arrest of several senior government officials in Limpopo, with few or no convictions in court. Provincial DA Chairperson Jacques Smalle stated that while welcome, the arrests alone do not equate to accountability; prosecution and securing convictions are equally crucial when guilt is proven.

Smalle shared that despite multiple arrests throughout Limpopo, the DA could only confirm a few recent convictions of municipal officials. The arrested individuals are facing various allegations, such as fraud, corruption, theft, and money laundering, in different courts across the province. The Directorate for Priority Crime Investigation, also known as the Hawks, reported that Maruleng officials were accused of diverting building plan application fees into their personal bank accounts, resulting in a loss of over R1.1 million.

Smalle criticized the low number of successful prosecutions, citing only a handful of convicted municipal officials in recent years, including three former officials convicted in VBS-related cases, all receiving suspended prison sentences.

The prolonged case involving Minister in the Presidency Khumbudzo Ntshavheni, who allegedly misused R2.5 million during her tenure as municipal manager of Ba-Phalaborwa Local Municipality, exemplifies the issue. Over two years after the Hawks referred the matter to the National Prosecuting Authority (NPA), a decision on prosecution has yet to be announced.

Recent cases illustrate the magnitude of the problem. Blouberg Municipal Manager Refilwe Ramothwala was arrested for allegedly irregular municipal security services tender, facing 73 charges, including fraud, theft, and money laundering. Ramothwala previously served as municipal manager of Maruleng, where he faced misconduct allegations in 2015 before joining Blouberg.

In another case, a service provider to Mogalakwena Local Municipality was arrested in connection with a R45 million fraud, corruption, and money laundering case, with further arrests expected. Earlier this year, the Hawks conducted an investigation into alleged fraud and corruption in municipal procurement at Molemole Local Municipality, leading to further arrests.

Elias Motsoaledi Local Municipality has also seen arrests this year, including a former legal manager and officials involved in an alleged cash-for-driving-licences scheme. While accepting these arrests, Smalle reiterated that arrests alone are insufficient; proper investigation and prosecution are necessary for accountability. He urged municipalities to take internal disciplinary action when sufficient evidence of misconduct exists, stating, "Limpopo does not need another cycle of allegations, arrests, and cases that disappear into the system."

Premier Phophi Ramathuba of Limpopo emphasized the urgency of tackling corruption to prevent it from spreading like cancer, highlighting the impact of compromised internal systems and corrupt public servants who accept bribes during a law-enforcement vehicle handover in Polokwane.
