Father of dead doctor dies before court decision on suing govt

Dr. Sebastian Joseph, a 30-year-old medical officer at the Kuah health clinic in Langkawi, tragically passed away in his quarters in 2010. His father, Dr. Joseph Anthony, had attempted to sue the government over his son's death but sadly, he too passed away before the outcome of the legal battle could be known. His father, Dr. Joseph Anthony, was laid to rest near his son, according to Joseph's lawyer, M Visvanathan, in a social media post.

Sebastian Joseph was found dead, kneeling with his hands clenched, at the Kuah health clinic in Padang Matsirat. A coroner's court delivered an open verdict, indicating that the inquest did not conclusively determine the cause of death. Joseph filed a lawsuit against the government for negligence, seeking compensation for the inadequate investigation and reimbursement for the expenses incurred in arranging a second autopsy.

However, both the High Court and the Court of Appeal dismissed the case, deeming it time-barred since the suit was filed outside the stipulated time frame. Despite this, in January of this year, the Federal Court agreed to evaluate whether Joseph could still bring a personal lawsuit against the government.
