Kavin murder case: Madras High Court quashes charge sheet against parents of main accused Surjith

The Madras High Court quashed the charge sheet filed against Saravanan and Krishnakumari, parents of Surjith, in the Kavin Selvaganesh caste killing case on September 29, 2026. Surjith was the main accused in the case, and Kavin, who was a Scheduled Caste member, had a relationship with Subhashini, a Siddha doctor. Surjith was murdered on July 27, 2025, and his cousin Jayapal, along with his parents, were also charged as co-accused.

The court dismissed the charge sheet due to a lack of eyewitnesses, CCTV footage, or any other electronic material that could establish the meeting between Surjith and his parents. The prosecution's case relied heavily on the mobile tower information, which the court deemed unreliable as it only indicated the operational range of the tower, not the exact location of the phone.

Justice R. Vijayakumar also noted the absence of a caste reference, insult, abuse, and public view in the telephonic communications between the accused, which are essential ingredients for invoking relevant Sections under the SC/ST Act. The court dismissed a petition filed by Surjith's cousin Jayapal, stating that his involvement in the murder is a matter for the trial and cannot be determined at the stage of a quash petition.
