AfD: Kerkeling und Maaßen bei erster Anhörung zu AfD-Verbot dabei

The AfD (Alternative for Germany) party is at the center of a debate concerning the potential introduction of a ban procedure in one of Germany's federal states. On the first day of this televised discussion, experts and a prominent entertainer appeared before a parliamentary committee in Erfurt. Invited were the constitutional lawyer Hans-Georg Maaßen, known for his controversial tenure as head of the Federal Office for Protection of the Constitution, and the entertainer Hape Kerkeling.

The motion for this hearing was initiated by the left-wing faction of the Thuringian state parliament, who have long advocated for a ban on the AfD. The opposition faction's aim is to actively push for such a ban procedure against the CDU-led government. Left faction leader Christian Schaft expressed hope that those still skeptical within the CDU faction would come to the realization that a Karlsruhe court should examine the feasibility of an AfD ban.

Kerkeling's media appeal is noted due to his known stance and engagement as a voice that resonates within society. He gave a highly publicized speech at the commemoration of the liberation of the Buchenwald NS concentration camp in Weimar earlier this year. Media interest surrounding the Erfurt hearing is significant, commencing with legal experts and specialists from institutions such as the Institute for Human Rights or the Society for Freedom Rights.

The Thuringian AfD, led by Björn Höcke, is perceived as particularly radical. They were the first regional branch of the party to be classified as 'securely right-wing extremist' by the Land's Federal Constitutional Court in 2021. Subsequent state authorities have followed suit. After the AfD's electoral successes in Sachsen-Anhalt and Mecklenburg-Vorpommern, the debate on a possible ban procedure has regained momentum.

However, there are also warnings, such as from the CDU faction leader Andreas Bühl. He suggested that the AfD's strong electoral performance might not constitute a compelling argument for initiating a ban procedure, and that the potential damage if the procedure fails should be assessed. Bühl emphasized that 'giving wind to the AfD should not be done.'

Two legal opinions concluded that the conditions for an AfD ban were met, yet the legal community remains divided on the likelihood of success for such a procedure. While proponents view the AfD as a significant threat to democracy, skeptics doubt the success of the ban mechanism. The AfD politicians reaffirm their stance against this move, stating that they have invited the media before the hearing - even though Kerkeling won't take the stand until around 7 PM.
