PLYMOUTH, Mass. (AP) — Lindsay Clancy will return to court on Tuesday for a hearing that may determine if she will face a second trial for the murders of her three children. This marks Clancy's first appearance in court since her initial trial concluded on September 4 with a hung jury. The judge dismissed the case due to an 11-1 verdict in favor of acquittal.

Clancy, a former nurse, confessed to killing her children but claimed she suffered from postpartum psychosis, a rare mental health condition that left her delusional and not responsible for her actions. Prosecutors acknowledged Clancy's mental health issues but argued she knew the consequences of her actions when she strangled the children and attempted suicide in 2023.

The defense has filed multiple motions that could be addressed during Tuesday's hearing. They have sought to dismiss the criminal case or conduct a new trial, arguing that the judge should have removed the single juror who favored a murder conviction after complaints about his unwillingness to consider reasonable doubt. Additionally, the defense is requesting an investigation into the juror's honesty regarding his responses to pre-trial questionnaires and behavior during deliberations, including the use of a cellphone.

Prosecutors have the option to retry Clancy on first-degree murder charges or pursue lesser charges, such as second-degree murder, manslaughter, or dropping the case entirely. Following the mistrial, Plymouth County District Attorney Timothy Cruz stated his primary goal was to provide justice for the three victims: 5-year-old Cora, 3-year-old Dawson, and 8-month-old Callan Clancy.

Prosecutors claim Clancy deliberately strangled the children with exercise bands while orchestrating her husband's departure from home on January 24, 2023. The livestreamed trial garnered significant public interest and highlighted the importance of maternal mental health post-childbirth. Clancy, who now uses a wheelchair due to a fall from a second-story window after the murders, remains charged with murder and is currently detained in a psychiatric facility awaiting the outcome of her case.
