EACC recovers road reserve adjacent to UoN Mombasa campus

The Ethics and Anti-Corruption Commission (EACC) has reclaimed a public road reserve valued at around Ksh25 million, located adjacent to the University of Nairobi's Mombasa Campus on Machakos Road. In a judgment from the Environment and Land Court on September 24, 2026 in case number E049 of 2023, Hon. Justice Y. M. Angima ruled that the parcel was illegally and fraudulently taken in 1994.

The court declared the lease and survey plan creating the land null and void, ordered the correction of the land and survey records, and permanently prohibited any further dealings with the property. The case stemmed from EACC's investigations into land reserved for public use, revealing that the road reserve had been unlawfully excised from Machakos Road and allocated to Ezekiel Luyali, a former Mombasa Municipal Council Councillor.

The fraud was facilitated by David Kalume Randu and Ahmed Mwidhani, who acted as Town Clerk and Mayor during the period. The illegal process lacked necessary gazette notices, a valid development plan, council approval, and Ministerial endorsement. The court found the 1994 allocation illegal, and EACC successfully demonstrated its claim for recovery of the property and the requested reliefs.

The court invalidated the 1994 lease and ordered the Chief Land Registrar to update the register by removing the lease entry. A permanent injunction was also issued to prevent further dealings with the property. The ruling emphasizes the stringent legal requirements for managing public land and its protection from unlawful conversion to private use.
