Attorney says there's "no evidence" Lindsay Clancy admitted killing her kids

Lindsay Clancy appeared before a judge on Tuesday to discuss a potential retrial in her murder case, which resulted in a mistrial after a single juror prevented a unanimous verdict. Clancy, 36, is accused of killing her three children with exercise bands in 2023. Her defense team argues there was no evidence to prove she understood her actions were wrong or to establish criminal responsibility, a condition known as insanity in Massachusetts.

The judge will consider whether to declare Clancy not guilty and prevent a retrial based on the juror's refusal to apply the court's instructions on proving guilt beyond a reasonable doubt. Defense attorney Kevin Reddington claims several jurors privately expressed they would have found Clancy not guilty by reason of insanity if not for the holdout juror.

His team has filed multiple motions to avoid a retrial, including arguing the mistrial was unjustified and would violate Clancy's right against double jeopardy.
