2012 Sowjanya rape-murder: How the case was botched, why Supreme Court has ordered fresh probe

Comedian Kunal Kamra has filed an application to the Supreme Court in an effort to join a case before a seven-judge Bench. The case examines the extent of legislative privilege under Article 194(3) of the Constitution and its potential conflict with citizens' fundamental rights, particularly freedom of speech and expression, under Articles 19(1)(a) and 21.

Kamra's involvement stems from a breach of privilege proceeding against him by the Maharashtra Legislature for his comedy show, Naya Bharat, which featured satirical remarks about then-Chief Minister Eknath Shinde. The comedian argues that the privilege proceedings undermine citizens' rights to express themselves and criticizes the potential chilling effect on free speech.
