Pakistan joins Hong Kong’s ValidAP trade platform

The Hong Kong government has initiated a one-month consultation process to reform the city's arbitration laws, aiming to bolster its appeal as a global dispute resolution hub, as outlined in the city's first five-year plan. The Department of Justice announced on Monday that the stakeholder consultation would address four key aspects of the arbitration process: efficiency, confidentiality, scope, and fairness.

Hong Kong's efforts to enhance its arbitration landscape align with its broader strategy to become a hub for finance, trade, and innovation. The city already ranks second globally for arbitration preferences, alongside Singapore, according to a 2022 survey by Queen Mary University of London. Key proposals under discussion include granting the Hong Kong International Arbitration Centre the authority to decide the necessary number of arbitrators when parties cannot agree, and permitting parties to seek judicial review of jurisdictional rulings where the tribunal deemed it lacked authority to hear a dispute.

These recommendations emerged from a working group chaired by Secretary for Justice Paul Lam Ting-kwok, and the proposed legislative amendments are expected to be introduced to the Legislative Council early next year, with the hope of finalizing them by 2027.
