US government sues Ohio hospital over wrongful firing of surgeon for 'being Jewish'

The US government has filed a lawsuit against Mercy Health, a hospital in Youngstown, Ohio, for the wrongful firing of a surgeon named Dr. Ian Walton, alleging that his religion and race played a role in his termination. According to the EEOC lawsuit, the hospital violated federal law by subjecting Walton to unfavorable terms and conditions of employment and ultimately firing him due to his Jewish identity and race, following the Oct. 7, 2023 terrorist attacks in Israel.

Dr. Walton had a successful practice with Mercy Health for many years, consistently exceeding productivity goals. However, he experienced antisemitic remarks throughout his employment, including comments blaming Jews for the Hamas attack on Israel. After the attacks, Walton faced increased harassment, was excluded from scheduled meetings, and had his surgery time blocks reduced. Ultimately, his contract was terminated in November 2023, despite his strong performance.

EEOC Chair Andrea Lucas stated that Walton faced a barrage of antisemitic comments in the workplace shortly after the Oct. 7 attack. The EEOC attempted to reach a settlement before filing the lawsuit, but ultimately decided to bring litigation to protect Jewish workers from unlawful discrimination and ensure they are not subjected to adverse action simply because of their religion or race. The EEOC emphasized that antisemitism has no place in the American workplace.
