High Court terminates Bank of Baroda administration of Infinity Industrial Park

The High Court in Kisumu, Kenya has ordered Inspector General of Police Douglas Kanja and other state officials to produce a report on their efforts to comply with court orders concerning the management of public protests and picketing. The officials were previously found in contempt of court for failing to fully comply with earlier directives.

The contempt proceedings stemmed from a lawsuit filed by victims and survivors of police brutality during the 2023 anti-government protests, represented by lawyers from International Justice Mission (IJM) Kenya and other human rights organizations. The court acknowledged the respondents' apology and their steps towards compliance.

Lead counsel Moses Omondi stated that the respondents will now provide regular updates on their progress every four months. The case shifted from the judgment stage to implementation, with petitioners continuing to monitor compliance until all orders are met. Lawyers representing the petitioners expressed readiness to participate in the anticipated public participation process for establishing a public order management framework.

Agnes Aron, representing the petitioners, noted the respondents' remorse and expressed satisfaction with their presence at the court. The lawyers also updated on the compensation awarded to victims, stating that an order requiring the government to pay compensation had been extracted and they were pursuing its fulfillment. The court's supervisory role requires the respondents to provide regular updates on their progress, with potential further action if reports are deemed inadequate.
