Welder sentenced to 7 years’ jail for causing death of wife’s lover

In a recent sentencing, a welder from Shah Alam was handed a seven-year and six-month prison term for causing the death of his wife's alleged lover in 2022. Justice Noor Hisham Ismail delivered the verdict after Chin Ngit Soon pleaded guilty to a lesser charge under Section 304(a) of the Penal Code, which pertains to causing death by negligence. Initially, Chin faced a murder charge, but the Attorney-General's Chambers offered a reduced sentence in exchange for his admission.

The incident occurred on November 25, 2022, at the carpark of a supermarket in Bandar Tun Hussein Onn, Cheras. Chin learned of his wife's affair with Wong Kim Miew a few months prior and implored her to terminate the relationship. Upon discovering Wong and his wife together in the latter's vehicle, Chin confronted Wong with a knife, intending to threaten him.

However, a scuffle ensued, and Chin accidentally stabbed Wong. Wong fled the scene, but stopped 150 meters away. Chin pursued Wong to a private hospital, which refused to admit him. He then transported Wong to Hospital Serdang, where doctors treated the victim. Wong succumbed to his injuries nine hours after the incident.

The judge emphasized that Chin's actions were motivated by emotion and not premeditated. He clarified that the fatal injury resulted from a struggle rather than a deliberate attack. Furthermore, Chin promptly took Wong to receive medical attention following the incident, visiting multiple hospitals until Wong's condition stabilized. The court concluded that Chin's actions were inconsistent with malice or disregard for the deceased.
