Supreme Court Rejects DHA Islamabad’s Income Tax Exemption Claim

The Supreme Court of Pakistan has denied the Defense Housing Authority (DHA) Islamabad's request for exemption from income tax. A panel consisting of Chief Justice Yahya Afridi, Justice Naeem Akhtar Afghan, and Justice Muhammad Shafi Siddiqui delivered the verdict on appeals brought under Section 49(2) of the Income Tax Ordinance, 2001.

Justice Siddiqui penned the decision. The court determined that an organization must possess legal authority to levy taxes or fees and manage municipal funds to be considered a local authority. Simply executing development and administrative tasks within a region does not align with local self-governance, the ruling stated. The decision emphasized that DHA Islamabad did not provide evidence of having the essential legal attributes of a local authority, such as the ability to impose taxes under its own name or maintain distinct funds.

Consequently, the Supreme Court dismissed DHA Islamabad's appeals and declared the authority ineligible for income tax exemption under Section 49(2) of the Income Tax Ordinance. The judgment also drew a comparison to the Thal Development Authority, which was acknowledged as a local authority due to its extensive statutory powers to impose taxes and manage its own funds.
