Pensioner who endured seven years of golf balls hitting his home finally wins RM100,000 from Jitra resort

A Kedah pensioner secured RM100,000 in damages after decades of stray golf balls entering his home, causing property damage and anxiety. At the Alor Setar High Court, judicial commissioner Aimi Zaini Azhar ruled that the operator of Darulaman Golf Resort and the landowner were jointly liable for private nuisance. Commissioner Azhar ordered the defendants to install safety netting, review tee marker positioning, and take further measures to stop golf balls from entering the pensioner's property.

The court gave the defendants 60 days to comply. Nazli Ahmad Mahyadin, 61, purchased his bungalow in Bandar Darulaman, Jitra, Kedah, in 2004 and moved in December 2018, adjacent to Tee Box 7. Golf balls began hitting his property almost immediately after he moved in, leading to cracked roof tiles, punctured poultry coops, shattered windows, and other damage.

Seven neighbors also testified about similar incidents. The judge found operating a golf course near a residential boundary inherently risky, as off-target shots could enter private yards. The court dismissed claims for special, exemplary, and aggravated damages, ordering the defendants to pay RM20,000 in costs.
