Calling husband ‘fatty shaped’, ‘black’ no reason for divorce: Chhattisgarh High Court

The Chhattisgarh High Court has ruled that a woman calling her husband "black complexioned" or "fatty shaped" cannot be grounds for divorce. The court found that the 28-year-old husband made several allegations of cruelty against his 25-year-old wife, but was unable to prove them. Justices Parth Prateem Sahu and Sachin Singh Rajput determined that the husband's family members had forcibly removed the wife with her mother when she visited after a miscarriage.

The court noted that the husband had not provided evidence to support his claims of desertion by his wife. The couple married in March 2019, and the wife lived with the husband and his family for about two to three months. The husband claimed that his wife treated him with hostility, threatened to implicate him in false cases, and went to her parents' home frequently.

Later, she suffered a miscarriage of twins. The wife alleged that her husband had an affair and started consuming alcohol and abusing her after finding out about it. She asked her mother and husband to take her back after her recovery, but they did not. The family court rejected the man's divorce application in August 2024, and he appealed to the high court.
