Sara Duterte impeachment: Why the Senate is fighting over the 16-vote threshold

The Philippine Senate is currently grappling with a crucial legal and procedural question during Vice President Sara Duterte's impeachment trial - how many senators must vote to convict her? The 1987 Constitution states that an impeached official cannot be convicted without the concurrence of two-thirds of all members of the Senate.

Initially, with 24 senators, this was interpreted as requiring 16 votes for conviction. However, four senators are not participating in the trial for various reasons, including detention and medical leave. This has led to a debate over whether these senators should be included in the calculation of the two-thirds requirement. The prosecution argues that only senators who can participate in the trial should be counted, suggesting that if only 20 senators are considered, 14 votes would be needed to convict instead of 16.

The defense, however, maintains that the 16-vote threshold should remain unchanged, citing that no supervening event justifies altering the rule during the trial. The decision will ultimately rest with the Senate, which has the sole power to try and decide impeachment cases under the Constitution.
