Resolving the Negeri Sembilan constitutional crisis

The constitutional crisis in Negeri Sembilan stems from the Undang Yang Empat's effort to remove Yang Dipertuan Besar, Tuanku Muhriz, resulting in an executive stalemate. If left unresolved, this situation could lead to total administrative collapse, with opposing factions rejecting any outcome. To address this predicament and ensure public welfare, the federal government should recommend the Yang di-Pertuan Agong declare a localized state of emergency under Article 150 of the Federal Constitution.

Like the 1977 Kelantan case, this would halt political games, suspend the state constitution, and enable a neutral caretaker administrator to maintain governance.

Under Article 34 of the Negeri Sembilan Constitution, the ruler can refer the matter to the Federal Court for an authoritative opinion. With the emergency in place, preventing rival factions from sowing chaos, the apex court can impartially assess whether the Undangs followed proper procedures and customary law, and whether the removal of the state executive council is legally sound.

While mediation by the Conference of Rulers or dissolving the state assembly for new elections might tackle political symptoms, they cannot definitively resolve the underlying royal dispute. Factional discontent among the Undangs is likely to persist. Only a comprehensive review by the Federal Court can provide a legally binding, indisputable verdict.

Combining an immediate emergency declaration with an expedited reference to the Federal Court offers the cleanest resolution path. This approach, similar to the 1977 Kelantan precedent, would stabilize the administration, allowing for a decisive legal remedy and ultimately restoring the rule of law in Negeri Sembilan.
