Mumbai MACT Awards ₹4.54 Lakh To BMC Worker Injured In 2017 Accident, Directs Tata AIG To Pay First And Recover From Owner

The Motor Accident Claims Tribunal (MACT) in Mumbai has awarded ₹4.54 lakh in compensation to a 52-year-old BMC worker named Kanta Ramesh Solanki, who sustained multiple fractures in a car accident in December 2017. The tribunal rejected her claim of a 56% permanent functional disability, noting that she had returned to her job as a Mukadam after roughly a year and continued working until her planned retirement in December 2021.

The incident took place on December 29, 2017, near Forges Road, opposite Anand Nagar Building, while Solanki was supervising her subordinates. A speeding car struck her from behind, causing a left subtrochanteric femur fracture and a left bimalleolar fracture. She was hospitalized for six days at Bhatia Hospital.

The tribunal ruled in favor of Solanki, attributing the accident to the negligent driving of the car. However, they found that the driver did not possess a valid driving license at the time of the accident, as the policyholder had only obtained a license on February 16, 2018, two months after the incident. Despite this breach, the tribunal ordered the insurer, Tata AIG, to pay first and recover the amount from the vehicle owner, ensuring that the claimant would not be adversely affected by the contractual dispute between the insurer and the owner.
