CFTC warns ‘mention market’ prediction contracts carry heightened manipulation risk

The Commodity Futures Trading Commission (CFTC) has issued a warning regarding the risks associated with prediction market contracts known as "mention" contracts. These contracts are based on a person's words, actions, or interactions, and the CFTC believes they carry a heightened risk of manipulation. This comes after a former White House teleprompter operator was fined for making over $107,000 trading prediction contracts tied to President Trump's speeches.

The CFTC's Division of Market Oversight has advised regulated entities that "mention markets" can only be listed under limited circumstances, as they do not meet the criteria outlined in the Commodity Exchange Act. The regulator argues that such contracts pose a higher risk of manipulation because their settlement depends on discrete conduct that may not be independently generated or externally verifiable.

Several cases have emerged where traders have been accused of exploiting privileged information on prediction markets, including the aforementioned White House teleprompter operator. To address these concerns, the CFTC has outlined four factors that exchanges should consider before listing mention markets: the presence of adequate oversight measures to detect manipulation, the independently verifiable nature of the words or actions used for settlement, external pressures that could influence the subject's conduct, and any external obligations the subject of the mention market may have.

CFTC Chair Mike Selig welcomed the guidance, emphasizing that regulatory clarity is crucial for sound markets. The CFTC has encouraged disclosures on the potential risks and unique considerations associated with listing mention markets on regulated exchanges.
