Muface, condenada a pagar a DKV por su seguro de salud

A Spanish mutual health fund, Muface, has been ordered to pay DKV, a health insurance subsidiary of Munich Re, 19.4 million euros for excess costs incurred during an obligation to cover its officials' health. The Central Court of Contention and Administrative Law in Madrid ruled in favor of DKV in a case brought by the insurer. The decision could be appealed at the Court of Contention of the National Court.

DKV claimed the extension of the health contract for Muface's officials was illegal due to Muface's failure to adequately plan and program the contract's bidding process. The court disagreed, stating that DKV's continued provision of health services was against its will. The ruling emphasizes that the payment to DKV must cover all direct, indirect costs, general expenses, and industrial profit.

Muface's defense argued that the extension of the contract was for the public good and to maintain the mutualists' right to healthcare. However, the court disagreed, stating Muface could not have predicted the contract would be deserted, as DKV claimed. DKV also seeks to recover an additional 80 million euros in interest on a previous contract's shortfall.
