Another aspect of Montgomery: it might make human brokers more valuable

The recent Supreme Court ruling in Montgomery vs. Caribe Transport II has the potential to make human brokers more valuable in the logistics industry, according to Beth Carroll, CEO of the Prosperio Group. This decision, which stripped away a key defense brokers have used to protect themselves from liability and negligence claims, could spur M&A activity among 3PLs as smaller companies seek to consolidate and mitigate higher insurance costs.

Carroll, who spoke on a panel focused on developing and keeping talent, expressed concern about the potential impact of artificial intelligence on the role of traditional carrier sales reps. She argued that human brokers will still be necessary to testify in lawsuits and ensure compliance with rules and regulations, even as AI takes over more aspects of the business.

Carroll also warned that straight commission pay packages, which are common in the industry, may not incentivize safe behavior when productivity increases due to AI. She suggested that companies would need to introduce an "adjustment factor" to prevent pay increases from outpacing the value brokers bring to the table. While AI has not yet played a role in executive search processes, Carroll noted that the importance of technology in 3PL leadership is becoming more evident, with equity compensation structures now requiring shorter vesting periods to keep up with competitors.
